Letter to the Editor: So Queen Creek thinks they're above the law?

As a resident of Encanterra, I am astounded that Queen Creek has determined to move ahead with annexation of our community despite a pending appeal before the appellate court.  Apparently they are so certain of the appellate court's decision they have already started changing our police, first responders and fire suppression services. 

At the December 12, 2019 trial Queen Creek lawyer Scott Holcomb said it would take five days to make the transition. But Queen Creek didn't even wait that long when they attempted to make the change before 8 am Monday morning. The judge's decision was issued late Friday, and certainly there are staff and scheduling changes to make in such a transition that take longer than a few minutes on a Monday morning. 

PCSO and Rural Metro have served Encanterra since the Shea development first opened its gates. They have served us well and know our complex streets and neighborhoods. So why the hurry? It isn't for our benefit. QC admitted at court before Judge McCarville that the "delay in annexation was affecting their tax base".

The annexation effort began in November of 2018 and organizers expected to complete getting signatures by the first quarter of 2019. Instead it took them nearly a full year to obtain and submit their petition with signatures, which should certainly make it clear that residents here weren't lining up in droves to sign.

There is a legal process at the appellate court that Encanterra Residents Against Annexation have the right to pursue. It isn't right Queen Creek and Shea are attempting to circumvent the court and our rights to rush annexation. It's been a year, they should wait until legal proceedings are concluded.

If Shea is getting funds from Queen Creek for improvements it means homeowners will pay for them twice...once when they bought and then again to Queen Creek in the form of higher taxes. Had this been explained earlier, I doubt if they could get any homeowners to sign the petition.

Gayle presents true facts!!!! I am appalled at the actions of our builder Shea and the Town of Queen Creek. They certainly don’t have our safety as their #1 priority by confusing Encanterra residents as to whom is providing our Fire and Police service currently. I was taught in government in school that appeals to judgements delay being able to carry out judgements and therefore the Town of Queen Creek is premature in collecting our tax dollars and moving our safety services. Maybe they will return our tax dollars if they lose the appeal???? Terri Trent
